Defining Terms

Riccarton Medical Services Ltd is a registered company in the United Kingdom. Throughout the document should we use the terms “we”, “us”, “our”, “Riccarton Medical Services” and “RMSL” this will refer to Riccarton Medical Services Ltd. By “you” and its variations, we mean “you” the reader and user of our products/services.

“Riccarton Medical Services’s Spaces” will refer to all customer facing areas which Riccarton Medical Services has a claim to. This means the website and all RMSL Social accounts. “Spaces” in general will refer to all types of customer facing areas.

Riccarton Medical Services reserves the right to refuse service, during or prior to initiation, without further justification.

We also reserve our right to the privacy of our internal workings. We are very transparent, but we reserve the right to not be.

Where a question occurs (digital or otherwise), requiring a response from you, you agree to respond truthfully to the best of your knowledge. For example, you won’t create tickets with fake emails which you know are not your email then deny this when asked.

Often our physical sites are not the sole right of RMSL, and are shared with other businesses or/and leased from companies that still maintain authority for purposes including, but not limited to, security and maintenance. You agree to act in accordance with authority that other parties may have should you interact with them on our premise.

Linking to Riccarton Medical Services Spaces is great, we love it.

Outbound Links in Our Spaces

Our spaces often host links to websites and profiles that are not managed by us or anyone even remotely affiliated with us. Links to spaces that are not directly operated by RMSL are not under our influence or control.

We are therefore not responsible for:

• the protection of any information you give to these websites
• any loss or damage that may come from your use of these websites, or any other websites they link to

You agree here that should you get into a claim or dispute with one of these parties, we will be released.

Using Content Produced by RMSL

Content we produce is copyrighted by default. You agree that you understand this and that you will not attempt to plagarise, “pirate” or proliferate any content produced by RMSL unless it is explicitly stated that it is acceptable to reproduce.

A list of such exemptions is here for you:

• Posts and Comments on 3rd party social platforms in the public domain (not private or restricted in anyway).

Our most relevant and recent content will appear on RMSL.co or other RMSL spaces.

Please note that many elements of our spaces are not content produced by Riccarton Medical Services. You are responsible to identify the party that has the rights to the content you wish to use and to act accordingly to the correct parties policies on the topic. We try to keep RMSL spaces up to date but we don’t provide guarantees, conditions or warranties that the information will be:

We’re not liable for any loss or damage that may come from using RMSL Spaces. This includes:

• any direct, indirect or consequential losses
• any loss or damage caused by civil wrongs (‘tort’, including negligence), breach of contract or otherwise

Requests to remove content

You can ask for content to be removed from RMSL.co. We’ll remove content:

• in order to comply with data protection legislation covering the rights and freedoms of individuals
• if it breaches copyright laws, contains sensitive personal data or material that may be considered obscene or defamatory

Contact us to ask for content to be removed. We will need you to include the URL and specify the exact content. We will, of course, let you know our position on the matter.

We remove content at our discretion. You can still request information under the Freedom of Information Act and the Data Protection Act.

We strive to ensure our website is free from viruses and malware, however, you take responsibility for the way you use RMSL.co and are responsible to ensure you do not expose yourself to the risk of malicious code, viruses or any element which could damage your computer system.

Viruses, hacking and other offences

Riccarton Medical Services takes a firm stance against material that’s malicious or technologically harmful. You must not introduce materials of this kind. This includes but is not limited to trojans, worms, logic bombs and viruses.

You must only attempt to gain access to elements of our operation which you are authorised to access. You agree not to attempt to gain unauthorised access to Riccarton Medical Services servers, connected databases and computers, or restricted areas of RMSL.co itself.

You must not attack RMSL.co in any way.

We make a solemn commitment to report every single perceived attack to the relevant law enforcement authorities and we will include any information we have about the aggressor with them.

Governing law

These terms and conditions are governed by and construed in accordance with the Laws of Scotland.

Scottish Courts have exclusive jurisdiction over any dispute you have which relates to these terms and conditions, or your use of RMSL spaces (whether it be contractual or non-contractual).

General

We’re not liable if we fail to comply with these terms and conditions because of circumstances beyond our reasonable control.

We may decide not to exercise or enforce any right available to us under this document. We can always decide to exercise or enforce that right at a later date.

Doing this once will not mean we automatically waive the right on any other occasion.

If any of these terms and conditions are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions will still apply.

There may be legal information elsewhere in RMSL spaces.

We reserve the right to change this document and our other policies without notice.

If the terms and conditions change and you continue to use Riccarton Medical Services platforms or services, your agreement is considered implicit.
